The things that can land you in the dock are as weird as some of the outrageous rulings made by the courts.
Some of the cases arbitrated by a city court recently and the judgments made upon them went overboard threatening to put the judiciary in collision with the church.
First, during the proceedings, a lot of what ought not to have been said was discussed in public and at lengthy.
In one of the case, a middle-aged woman had been charged with attempted “Nyerification”.
According to the prosecution, the woman had cut off her husband’s penis nearly severing it and the man had to be flown to South Africa to have it sewn back.
Asked why she wanted to chop off her husband’s penis, the businesswoman told the presiding magistrate that her husband had an undersized “firewood” that could not sufficiently light the fire down there. “The said penis was a “mere frustration” during the night,” she said in a pin drop silent court.
The woman said she did not see the use for the kanyamu that could not reach the deepest parts of her land of honey and milk.
In what is seen to be the exact opposite of what the church advocates for, the magistrate advised the man to make sure he sleeps with a woman before marrying her and ask if she was comfortable with his tool of procreation.
In another case, a Nigerian man and his Kenyan girlfriend were charged with taking part in an unlawful fight at a public place.
The two had fought at Embakasi CID offices where the woman was recording statements after accusing her boyfriend of conning her off millions of shillings and assaulting her.
The magistrate sought to get to the exodus of the acrimony between the two.
“Love was so sweet in the beginning and I enjoyed sex with him more than any other man because he was uncircumcised. I showered him with money and gifts because I loved him and every moment with him,” said the woman.
“But I came to know that he had family in the neighborhood and used my money for their upkeep”.
The magistrate intervened asking the difference between him and the circumcised men. She said, in the fully packed court session, that the oga could sustain an erection for long hours and take her to cloud nine.
She told the court that she was thinking of forgiving him and taking him back into her Nyayo Estate house because she couldn’t live without him.
The magistrate likened the woman’s act with that of a foolish person who bites the finger that feeds them and told the man to apologise for assaulting his girlfriend. He told the Oga that he can use “whatever is at your disposal to earn a living but avoid turning violent in the future”.
